1. Agreement to these terms

These Terms of Service ("Terms") govern your access to and use of the website at www.nicole-nora.com and any related content, products, courses, memberships, quizzes, and services (together, the "Services") offered by MARCOMTREASURES LLC, doing business as Nicole & Nora ("Nicole & Nora," "we," "our," or "us"). By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

2. Who we are

Nicole & Nora provides educational content about dog behavior, body language, communication, and responsible dog ownership, including a blog, guides, quizzes, a newsletter, and paid courses and memberships. Our content is educational only and is not a substitute for professional veterinary or behavioral care (see our Disclaimer).

3. Eligibility

You must be at least 18 years old, or the age of majority where you live, to make a purchase or create an account. By using the Services, you confirm that you meet this requirement.

4. Accounts and memberships

Some Services, such as our membership, require an account. You are responsible for keeping your login details secure and for all activity under your account. Please provide accurate information and keep it up to date. We may suspend or close accounts that violate these Terms.

5. Purchases, billing, and auto-renewal

When you buy a course, guide, or membership, you agree to pay the listed price plus any applicable taxes. Paid memberships are billed on a recurring basis (for example, monthly) and automatically renew at the then-current price until you cancel. You can cancel at any time, and cancellation takes effect at the end of your current billing period. Full billing, renewal, and refund details are set out in our Refund & Cancellation Policy, which is incorporated into these Terms.

Some courses may be sold and delivered through a third-party platform (for example, astratrainer.com). Purchases made there are also subject to that platform's terms and billing.

6. License to digital content

When you buy or access our digital products, courses, or guides, we grant you a personal, non-transferable, non-exclusive license to use them for your own personal, non-commercial purposes. You may not copy, resell, share, sublicense, or redistribute our paid content without our written permission.

7. Intellectual property

All content on the Services, including text, graphics, photos, logos, courses, and guides, is owned by us or our licensors and is protected by intellectual-property laws. The Nicole & Nora name and branding may not be used without our permission.

8. Acceptable use

You agree not to misuse the Services, including by attempting to gain unauthorized access, disrupting the site, scraping content, infringing others' rights, or using the Services for anything unlawful.

9. Educational content, not professional advice

Our content is for general education and information only. It is not professional training, behavioral, medical, or veterinary advice, and results are not guaranteed. Always consult a qualified professional or your veterinarian about your specific dog. See our Disclaimer for details.

10. Third-party links and affiliates

The Services may link to third-party websites and may include affiliate links, where we may earn a commission at no extra cost to you. We are not responsible for third-party content, products, or practices.

11. Disclaimers

The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or that content is complete or accurate.

12. Limitation of liability

To the fullest extent permitted by law, Nicole & Nora (MARCOMTREASURES LLC) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of the Services or reliance on our content. Our total liability for any claim relating to the Services will not exceed the amount you paid us in the twelve (12) months before the event giving rise to the claim.

13. Indemnification

You agree to indemnify and hold Nicole & Nora (MARCOMTREASURES LLC) harmless from claims and expenses arising out of your use of the Services or your breach of these Terms.

14. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws rules. You agree that any dispute relating to these Terms or the Services will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to their jurisdiction, except where applicable law provides otherwise.

15. Changes to these terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date above. Your continued use of the Services after changes take effect means you accept the updated Terms.
